These Terms of Service (“Terms”) apply from the date they are published on our website and govern your use of the website and every purchase you make through it.
1. Scope and Contracting Party
1.1 These Terms apply to your use of the website Sage Larose (sagelarose.com) and to all purchase agreements made through it.
1.2 The seller is Sage Larose (“we”, “us”, “our”).
1.3 Any different terms proposed by you do not form part of the agreement unless we expressly accept them in writing.
2. Language and Contract Copy
2.1 The agreement is concluded in English.
2.2 We email you your order details and a link to these Terms after your purchase. We recommend that you save or print them for your records.
3. Eligibility and Accounts
3.1 By placing an order, you confirm that you have reached the age of majority in your province or territory of residence and have the legal capacity to enter into a contract.
3.2 To use certain features, we may require information such as your email address and your billing, payment and delivery details. Please make sure this information is accurate and complete.
3.3 You are responsible for keeping your login details secure. Your customer account may not be transferred to a third party.
4. Our Products and Product Descriptions
4.1 We aim to present our products as accurately as possible.
4.2 Minor variations in colour or finish, for example due to screen settings or natural variations in manufacturing, are not a defect.
4.3 Product descriptions may change. We may stop selling a product or limit order quantities.
4.4 Images. Some images on our website, particularly illustrative, promotional or conceptual images, may be generated or assisted by artificial intelligence (AI). These are used to improve visual presentation and are identified. We use real photos of the actual product for all product pages.
4.5 If the product you receive is materially different from its description, Section 10 applies.
5. Formation of the Contract
5.1 The display of products in our online store is not a binding offer, but an invitation for you to place an order.
5.2 By submitting your order, you make an offer to enter into a purchase agreement.
5.3 You will receive an order confirmation by email shortly after ordering. This confirmation does not mean we have accepted your offer.
5.4 The agreement is formed when we confirm your order in a separate email or when your item is shipped.
5.5 We may decline orders, in particular where we suspect misuse, fraud or commercial resale. Any payment already made will be refunded in full.
5.6 Orders may be shipped in more than one package. This never results in additional shipping costs for you.
6. Prices, Shipping, Taxes and Import Charges
6.1 All prices are shown in Canadian dollars (CAD).
6.2 Applicable taxes (GST/HST/PST/QST, depending on your province or territory) are calculated and displayed at checkout before you pay.
6.3 Unless stated otherwise, standard shipping within Canada is free. There is no minimum order value.
6.4 The price displayed when you place your order applies and is stated in your order confirmation. Later price changes do not affect existing agreements.
6.5 If a price has clearly been displayed in error, we may cancel the order. Any amount already paid will be refunded in full.
6.6 Our products ship from Asia, so your parcel may be subject to Canadian customs clearance.
- All applicable duties and import taxes are included in your order total. You will not be asked to pay anything extra on delivery.
7. Payment
7.1 Payment is made using one of the methods offered at checkout.
7.2 By paying, you confirm that you are entitled to use the selected payment method and that any discount code you use is valid.
7.3 Payments are handled by third-party payment providers, whose own terms apply to their services. All payments are protected with SSL encryption.
7.4 If there is a payment or refund dispute, please contact us first. In most cases this is the fastest way to resolve it.
8. Delivery
8.1 We deliver to all provinces and territories in Canada. Orders ship from Asia.
8.2 Order processing normally takes 1–3 business days, and in rare cases up to 4 business days. The estimated delivery time after shipping is 8–12 business days, and in rare cases up to 13 business days.
8.3 If your order has not been delivered within 30 business days of our order confirmation, you may cancel it and receive a full refund of the purchase price.
8.4 Delays caused by customs or carriers are outside our control, but we will help you track and resolve them.
8.5 Risk of loss or damage passes to you when the goods are delivered to you.
8.6 If you refuse a delivery or do not collect it from customs, the resulting costs and fees may be charged to you, to the extent permitted by law.
9. Returns and Refunds
9.1 We offer a 90-day return period from the delivery date, subject to the conditions in our Return & Refund Policy, which forms part of these Terms.
9.2 Return shipping costs are paid by the customer, except where the item is defective, damaged or incorrect.
9.3 Restocking fee: None.
9.4 Non-returnable items: e.g. personalized or made-to-order items, gift cards, final sale items.
10. Defective, Damaged or Incorrect Items; Statutory Rights
10.1 If a product is defective, damaged or not as ordered, please contact us within 7 days of delivery with your order number and photos so we can resolve the issue quickly.
10.2 After review, we will send a replacement or issue a full refund, at no cost to you, including return shipping.
10.3 Nothing in these Terms limits your rights under applicable federal and provincial or territorial consumer protection and sale of goods laws, including statutory warranties and your rights relating to defective goods, late delivery and distance sales. These rights vary by province and territory.
11. Discount Codes
11.1 Only one discount code may be used per order.
11.2 Discount codes have no cash value and cannot be redeemed for cash.
11.3 In the event of a return, the amount actually paid is refunded.
12. Use of the Website
12.1 You may not use the website for unlawful, fraudulent or abusive purposes. In particular, you may not distribute malware, collect personal information without consent, bypass security measures, or use automated tools to access the site without our permission.
12.2 In the event of serious violations, we may restrict your access to the website.
13. Reviews and Submitted Content
13.1 If you submit reviews, images or other content to us, you grant us the right to publish and adapt it in connection with our services. You may withdraw this permission at any time.
13.2 You confirm that you hold the necessary rights to the content and that it does not infringe the rights of any third party.
13.3 We may remove unlawful or offensive content. We do not publish fake reviews or pay for positive reviews.
14. Intellectual Property
14.1 All content on this website, including texts, images, graphics, logos, videos, product descriptions and design, is protected by copyright and other intellectual property laws.
14.2 Copying, distributing, modifying or commercially using this content without our approval is not permitted.
15. Links to Third-Party Websites
15.1 Links to third-party websites are provided for information only.
15.2 We are not responsible for the content, offers or privacy practices of third parties. Complaints about third-party products and services should be directed to the relevant provider.
16. Privacy and Marketing Communications
16.1 Information on how we collect and use your personal information is in our Privacy Policy, prepared in line with Canada’s Personal Information Protection and Electronic Documents Act (PIPEDA) and applicable provincial laws.
16.2 We send marketing emails only with your consent, in line with Canada’s Anti-Spam Legislation (CASL). Every marketing message includes an unsubscribe link, and you can withdraw your consent at any time. Order-related messages will still be sent.
17. Limitation of Liability
17.1 Nothing in these Terms excludes or limits our liability for death or personal injury, for intentional or grossly negligent conduct, or for anything that cannot be excluded or limited under applicable law.
17.2 Subject to Section 17.1 and to the extent permitted by applicable law, our total liability to you for any claim arising from a purchase is limited to the amount you paid for the relevant order, and we are not liable for indirect or consequential losses.
17.3 Some provinces and territories do not allow certain limitations of liability, so parts of this Section may not apply to you.
18. Force Majeure
We are not responsible for delays or failure to deliver caused by circumstances beyond our reasonable control, such as natural events, supply chain disruptions, government actions, labour disruptions or transport delays. Your statutory rights are not affected.
19. Errors and Inaccuracies
Despite careful review, product descriptions or other information may contain errors. We may correct such information going forward. Agreements already concluded are not affected.
20. Dispute Resolution
20.1 We aim to resolve issues directly and quickly. Contact us at info@sagelarose.com. We respond to complaints within 14 days.
20.2 If we cannot resolve a dispute together, you may contact your provincial or territorial consumer protection office. You may also contact your card issuer or payment provider about a payment dispute, where applicable.
20.3 Nothing in these Terms prevents you from bringing a claim before a court in your province or territory of residence.
21. Governing Law
21.1 These Terms are governed by the laws of State of Wyoming, United States and the federal laws of Canada applicable there.
21.2 Mandatory consumer protection laws of your province or territory of residence, including Quebec, continue to apply to you and are not affected by this choice of law.
22. Changes to These Terms
We may update these Terms for future orders. For each order, the version published on the website at the time the agreement was formed applies.
23. General Provisions
If any provision of these Terms is found to be invalid, the validity of the remaining provisions is not affected.
